These terms and conditions (the "Terms") (together with the documents referred to in it) tell you the terms on which you may make use of our website www.GiveitAPP.org and mobile app called "GiveitAPP" (together, the "Site").
Please read these Terms carefully before you start to use this Site, as these Terms will apply to your use of this Site. By using this Site, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not use this Site.
This Site is owned and operated by Jigga Investments Limited, a company registered in England and Wales under number 09542854 with its registered office 6th Floor Charles House, 108-110 Finchley Road, London NW3 5JJ ("GiveitAPP", "we", "our", and "us").
1. THESE TERMS
1.1 These Terms constitute the agreement between you and us for the use of this Site and the contents and services available through it.
1.2 We may change these Terms from time to time. Any changes we may make to these Terms in the future will be posted on this Site and, where appropriate, notified to you by email. Please review this page frequently to see any updates or changes to these Terms.
1.3 If you commit a breach of these Terms we reserve the right at our sole discretion to immediately and without notice suspend or permanently deny your access to all or part of this Site and associated services.
2. THIS SITE
2.1 This Site is still under development and testing. We provide this Site on an "as is" and "as available" basis with all faults. We do not guarantee that this Site, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw, discontinue or change all or any part of this Site without notice. You agree that your use of this Site is at your own risk. We will not be liable to you if for any reason any of this Site is unavailable at any time or for any period.
2.2 Unless specifically stated otherwise, any new features, services or software applications introduced shall be subject to these Terms.
3. YOUR ACCOUNT AND PASSWORD
3.1 You must be 16 years or older to be eligible to register with us, and to use this Site. By using this Site, you represent and warrant that you are 16 years or older.
3.2 If you register with us, you must provide true and accurate information about yourself. Should the registration information provided prove false or misleading, we may suspend or terminate your account.
3.3 You are responsible for maintaining the confidentiality of your account details, including any user identification codes, passwords or any other piece of information that forms part of our security procedures, and you must not disclose these to any third party.
3.4 You are responsible for all activity under your account even if someone else uses your account. You authorise us to act on instructions received under your account and we will not be liable for any loss that you might suffer through following such instructions whether by you or another person.
3.5 We have the right to disable any user ID or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.
4. YOUR PRIVACY
4.1 Our Privacy Policy will apply to your use of this Site. The Privacy Policy sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using this Site, you acknowledge the contents of the Privacy Policy and assure us that all data provided by you is accurate.
4.2 Certain functions on the mobile app version of this Site will make use of location data sent from your device to provide and improve location-based products and services. You can turn off this functionality at any time by turning off the location services settings for this Site on the device.
5. CHARITIES
5.1 You can use GiveitAPP to make donations to charities that are listed on our platform.
5.2 Payments to charities are facilitated by our fundraising provider JustGiving. In order to make a donation on GiveitAPP, you must open an account with JustGiving and accept JustGiving’s terms of service and privacy policy.
5.3 We do not warrant that your donations will be used by the charity for any particular purpose. If you want your donation to be used for a specific purpose or for a particular appeal, you should contact the charity and make your donation directly to them.
5.4 We assume no responsibility for the charities listed on this Site. The fact that a charity is listed should not be interpreted as endorsement by us of that charity. Please make your own enquiries to satisfy yourself that the objects of the charity are in line with your intentions.
5.5 We shall not be responsible for any dissatisfaction you may have regarding the recipient charity's use of any donation you may make through this Site or for any misuse or non-use of such donations by the recipient charity. After donations are made, all further dealings are solely between you and the recipient charity.
6. MAKING DONATIONS
6.1 In order to make a donation using this Site, you will need to enter your debit or credit card information. You acknowledge that payment processing services are provided by JustGiving and that payments are not processed by GiveitAPP.
6.2 You warrant that you have appropriate authority to use the payment card details which you input. By inputting your debit or credit card information, you agree to use of that information by our third party payment processor for the purpose of paying your bill and processing your donation.
6.3 We do not store your payment card details on our systems, although we retain some of the digits. This enables you to identify your appropriate payment card on subsequent occasions and on your payment receipt. You may add and remove payment cards from this Site at any time.
6.4 Please note donations are non-refundable for any reason.
7. CHARGES
7.1 Payments processed through JustGiving are subject to a standard card processing fee of 1.9% plus 20p.
7.2 Save as stated in paragraph 7.1, no fees are charged by GiveitAPP or our fundraising provider JustGiving for processing your donation. However, you can make a voluntary contribution to support the GiveitAPP and JustGiving platforms.
8. INFORMATION
8.1 GiveitAPP is not an accounting, taxation or financial advisor, and you should not rely on information given on this Site or its associated services to determine the accounting, tax or financial consequences of making a donation to charity. We strongly recommend that you consult your own adviser(s) about any accounting, taxation or financial consequences that may affect you.
9. ACCEPTABLE USE RESTRICTIONS
9.1 You must at all times use this Site and its associated services in a responsible and legal manner. In particular, you must not:
9.1.1 misrepresent your identity or affiliation with any other person or organisation;
9.1.2 use this Site to send junk email or 'spam' to people who do not wish to receive email from you;
9.1.3 use this Site to conduct, display or forward surveys, raffles, lotteries, contests, pyramid - schemes or chain letters;
9.1.4 disclose any information relating to any person except with the consent of the person or as permitted by applicable local laws;
9.1.5 use this Site to defame, stalk, bully, abuse, harass, threaten, impersonate or intimidate any person;
9.1.6 upload any offensive, obscene, racist, defamatory, misleading or deceptive content, on to this Site or its associated services;
9.1.7 interfere with, or disrupt, the service or services or networks connected to the service and introduce any computer virus (including any variant or similar malicious code or instructions) to the GiveitAPP systems.
9.2 If you notice any content that does not comply with these standards, please contact us.
10. USER CONTENT
10.1 You are solely responsible for any data, text, images, graphics, audio and video, and other content ("Content") that you submit, post or display on or via this Site. We do not claim ownership of any Content and you grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use and publish the Content for the purposes of this Site.
10.2 If you create Content on GiveitAPP, you must ensure that any information you provide is accurate and not misleading.
10.3 Building a GiveitAPP page or posting content in aid of a Charity in no way implies GiveitAPP's or the Charity's endorsement of your content. GiveitAPP reserves the right, at its absolute discretion and without notice, to remove any shared content at the request of the Charity, in the event that the Charity, in its absolute discretion, deems your content to be inappropriate.
10.4 GiveitAPP does not actively monitor or edit this Site but reserves the right (without accepting any obligation to do so) to remove or edit any user Content posted on this Site or its associated services at its sole discretion and without notice.
11. INTELLECTUAL PROPERTY RIGHTS
11.1 All content on this Site and its associated services is owned by GiveitAPP, our listed charities or our other original licensees, and is protected by the applicable intellectual property and proprietary rights and laws. You may copy content for your own personal, non-commercial use provided you do not alter it or remove any copyright, trade mark or other proprietary notice. No other use of this Site's and its associated services' content is permitted without the express prior permission of GiveitAPP, and, where applicable, the copyright holder. 12. TRADEMARKS
12.1 The name GiveitAPP and the GiveitAPP logo are trade marks of GiveitAPP or our licensors and may not be used in connection with any product or service that is not GiveitAPP's, nor in any manner that is likely to cause confusion, or in any way that may disparage or discredit GiveitAPP. Other trademarks or logos that appear on the Site (including specifically those of listed charities) are the property of their respective owners and are likely to be registered trademarks and subject to restrictions as to their use. They must not be used without the express permission of both GiveitAPP and the trademark owner.
13. DISCLAIMER
13.1 We do not guarantee that this Site, or any content on it, will be free from errors or omissions.
13.2 The information provided on this Site is for general information only. We do not offer advice on which you should rely. Although we make reasonable efforts to update the information provided by this Site, we make no representations, warranties or guarantees, whether express or implied, that such information is accurate, complete or up to date.
13.3 To the maximum extent permitted by law, we disclaim any and all implied conditions and warranties that this Site and the information and services available through it are of satisfactory quality, accurate, fit for a particular purpose, or non-infringing.
14. LIMITATION OF OUR LIABILITY
14.1 GiveitAPP shall only be liable under these Terms for losses which are reasonably foreseeable and caused by GiveitAPP's breach of these Terms or GiveitAPP's negligence.
14.2 This Site is for domestic and private use. We are not liable for business losses. If you use this Site for any commercial, business or resale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
14.3 In any event, our maximum aggregate liability to you in respect of this Site (whether in contract, tort (including negligence), breach of statutory duty or otherwise) shall in no circumstances exceed the sum of £10.
14.4 Nothing in these Terms excludes any statutory rights which may apply to your use of this Site and associated services which cannot be excluded, restricted or modified by contract.
14.5 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors or for fraud or fraudulent misrepresentation.
15. VIRUSES
15.1 We do not guarantee that this Site will be secure or free from bugs or viruses.
15.2 You are responsible for configuring your information technology, computer programmes and platform in order to access this Site. You should use your own virus protection software.
15.3 You must not misuse this Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to this Site, the server on which this Site is stored or any server, computer or database connected to this Site.
16. THIRD PARTY LINKS
16.1 Where this Site contain links to information, websites and resources provided by charities and other third parties, these links are provided for your information only. We have no control over the contents of those websites or the performance of the services. Your dealings with, and interest in, charities found on or via this Site is solely between you and the charity with whom you are dealing. Accordingly, you use these services at your own risk and we accept no responsibility for them or for any loss or damage that may arise from your use of them.
17. TERMINATION
17.1 You may discontinue use of this Site and associated services at any time. These Terms will continue to apply to any past use by you of this Site.
18. MISCELLANEOUS
18.1 If we do not exercise or enforce any legal right or remedy which may be available to us, this will not be taken to be a formal waiver of our rights.
18.2 If any part of these Terms shall be unlawful or unenforceable for any reason, this shall not affect the remainder of these Terms and that part shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

19. APPLICABLE LAW
19.1 These Terms are governed by English law and you can bring legal proceedings in respect of this Site in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
